I saw and apt in marthahalli, and the flat which is shown to me is not thr in the approved master plan . Is this a Legal one . Will thr be any problem if i purchase it ?.

hi,
If the flat which ur intending to purchase is not shown in master plan,absolutely there will be no katha and even u don't get loan also.
In total it is not approved flat, it cant be called as flat which has been constructed by violation of sanction plan.

Builder is telling that that was an old plan , they have a revised plan with approval. Is it possible to revise initial plan and get approved ?
Builder told they have B katha, because at the time of construction its not under BDA/BBMP
Please advice

First things first: I'm not a lawyer, but I've dealing with lot of agents/lawyers/bank officials since last 3-4 years for buying property for myself. I'm sharing my experience and info I've gathered till now.
You dont get loan to buy an apt constructed on a land with B Khata (As clearly told to me by a bank manager). And, an approved plan cannot be revised. Builder can scrap the approved plan and get a new plan approved. But, it will cost some money to the builder and mostly they wont do it. Also, some builders grossly violate rules, putting the purchasers ar great risk. All these builders say they will get these violations regularised in "Akrama Sakrama"
I would like to share one of my experience. I paid 50K advance and booked an apt in Uttarahalli with a builder. After booking, he gave me property docs for legal verification. He also arranged for loan from a nationalised bank (Yes, he did!!). But, during scrutiny, my advocate found the following issue. Builder had two adjacent pieces of land (Say A & B). He had taken approval to build the apt in piece A and BBMP had notified to acquire piece B for road extension. But, the builder had built the apt in piece B (but planned and approved in piece A). When I found this, the builder duly returned my 50K. Later, when one of my friends approached same builder to buy in the same property, I gotta see the same set of documents. But, the builder had manipulated the doc to show that, he has approval to build in piece B and was hiding that piece of property document which indicated BBMP notification.

Even though you can buy and register it in your name and pay the taxes every year, legally and as per the official documents, there is no Flat in that floor and you are not the owner. As long as revenue comes BBMP, BWSSB & KPTCL keeps on accepting the deposits and taxes. When it comes to legal point, they say its an illegal asset and they promptly agrees to demolish it. Finally you will become an empty handed guy, loose your money as well as peace of mind.
In bangalore also many apartments and commercial complexes built by encroaching the storm water drain or the roads are under threat and demolition drive is undeway. Last month one of the commercial complex with Apartment which housed HDFC Bank was demolished declaring illegal. Just one week back itself an entire apartment complex near banaswadi was declared illegal and demollished. Another case of road encroachment was cleared at the famous Apartment in BG Road L&T South City.
Don't encourage builders by buying such assets. Go only for BBMP or BDA fully approved projects.
