Neighbour has not left any offset

Hi,
My right side neighbour has not left any offset while constructing the house(about 50' used completely and no compound walls). This is old BBMP area and consturction had been done more than 10yrs back. He has kept one small window(2*2) facing my site
My questions are below
1) when I construct the house, should I need to leave any offset? Even if I leave the offset there is no possibility of light coming in because his side is completely used.
2) Will the neighbour complains if I do not leave any offset and construct like he has done? If complains what should be done?
3) will the BBMP approves the plan if I do not leave any offset and construct?

Kindly provide your valuable insights in to this problem.

for approval plan from BBMP, you need to show the specified set back areas. after approval, you can do as per your wish by giving some adjustments. In any case your neighbor cannot escalate on your construction, as he himself has violated those rules for his building.

You may not get much light, but will get some (something is better than nothing).
But you will still get some air.
Better for you to follow the BDA/BBMP rules (than have to deal with all kinds of extortion tactics from the officials/cops)

I would say, leave the prescribed offset from your side and buy peace. Why do you want to do something against rules and live in a perpetual fear of BBMP harassment for the rest of your life? I understand at times following rules 100% is not practical and possible, but atleast in cases where its possible to follow them as far as possible. What if after few years your neighbour demolishes his existing building (since its already 10 years old) and construct a new one with the required offsets left. You will be in trouble if he then thinks of going to court for it.
