Docs list expected from Land developer
Hi,
I saw announcement about Advocate joining the group.
Pls let me know what is the list of documents that I should expect from Land developer (layout developer) before booking the plot.
My developer (Astro Developers, Sarjapur road) is demanding Rs 1Lac as booking payment before giving me the documents to verify.
Is it the general practice and amount is fair?

Initially every developer says, he has clear titles. Majority of the cases, they just have GPA in their name from the original land owner. So Its not safe to pay such amount without verifying the documents. If at all you wud like to pay, pay a small amount like Rs.1000 to 5000/- and take a clear written agreement from him that he will refund the entire amount, if the verification of the documents proves not valid. Only after the documents verification and confirmation from a legal advisor, go for booking the plot.-

1) Absolute sale deed
2) Khata
3) DC Conversion doc.
4) Encumberance certificate till date(from last 13 years)
5) Tax receipts till the date
6) Approved layout plan.
7) Family Tree of the land owner
Note: BBMP/BDA approval available only for the layouts having equal/more than 10 Acres area and compliance to their specification like the living area should not be more than 49% of the toal layout area and remaining 51% area will be for the common amenities.

I think your note is partly incorrect. I have seen the BBMP approval for a layout when they have not left any land for parks/CA etc.
Also I think there should be one more doc you should get, that is BDA NOC.

Whether its BDA or BBMP, They never give 100% persmission in one shot for the entire layout area. They give in 2 or 3 levels based on the satisfactory developments in the layout/progress/completion. Few developers take first permission and fool the customers saying they have BDA/BBMP approval and sell the entire project area.
Secondly thre is a clear demarcation between the BBMP and BDA limits. if the project area is coming under BBMP limit, BDA NOC is not required, if not BDA, NOC is also a must doc.

I have seen a plot in kanakapura road (its a gated comunity), its just DC conversion coming under BDA limits, but they do not have the BDA approval, just the DC Convesion and tax is paid to Gram panchayat not to BBMP.
is it a safe to buy ?

Dear Kiran
Every layout which falls within BDA limits shall take approval from BDA. In your case it is not there . Risk is involved if it is going aquire for public purpose .In spite of this if you want proceed better you take no objection certificate from BDA ( to that effect that the sy No is not in the acquisition of BDA)

Msn's list is quite helpful. Just a question- isn't the receipt for betterment charges paid by the developer a required doc as well?
