Hi Murali,

I need your advice and service. I own a site near electronic city phase2, its a gramathana site bought in 2003. when Akrama Sakrama came in 2007 my father filled the application and paid around 6.5 lakhs to the concerned department, the next day there was a stay and the scheme was stopped. I waited almost 4 years still its in the court. How can I collect my money back now?

Please guide me.

Hi Mr. Murali ,

I heartily appreciate your rendering legal advice in this forum to the members of this useful forum..

I have a site in Bangalore allotted by a Housing society & I have all the documents like Sale deed , BDA Approval , Khata & Latest Tax paid till 2011-12. However due to a mischief done by a neighbouring Housing society in collusion with some corrupt BDA officials some other persons belonging to the other Housing society have been issued Sale cum lease deed & Possession certificate. The persons who have these documents have managed to get a fake modified layout plan according to which , it clashes with my site. But as per the Approved Master Plan available in BDA the site no. given to me is shown & matches with physical site dimension. The site has measurements is North to south 40' & 42.5' X 47.5' East to West .Whereas the rival claimant has PC for 30'X40' which does not match with the physical dimensions.There are also many other loopholes in the claim of Rivals as these documents were obtained in a fraudulent manner. The rivals have been fighting to get the absolute sale deed & Khata for years but BBMP/BDA is refusing to issue the same. Therefore members of the association have gone to courts & lost also.

But a set of people belonging to the rival Housing society are fighting with BDA legally & not allowing myself & neighbours to construct houses on the vacant sites. In my case I had started construction of a compound wall to protect the property but before the superstructure could be built another person of the rival society went ahead with putting a Barbed wire fence & when he had half completed a garage the person was hauled up with police intervention & he gave written assurance to the Police that he will not further construct the garage till the dispute is settled. Thus the Garage is half constructed without a roof.

Thus it is apparent that the site is not presently in my in my possession because of the materials of the rival claimant lying in my site inspite of having all genuine documents.

What should be my response to get the physical possession & to ensure that I can construct the house on the plot. I await your advice as below :

1) Should I pressurise the Police to intervene & ensure that the tresspasser is evicted from my site ?

2) Is there any such enforcement force in BBMP for evicting such trespassers when BBMP/BDA have issued the Khata in my Name?

2) Or is it necessary to start legal action to evict the tresspasser of his materials & handover the site to me?

Kindly advice me on the next course of action? In case you need any further details to understand the case bettere , I shall furnish the same immediately.

Hi

Since you are possessing absolute sale deed,PC and up to date katha and other documents it is deemed that you are in possession as per the documents .
after going through you posting i dint understand what is the dispute between your society and rival society.
any my response to your questions as hereunder...........

You can do it and it would be the fastest relief rather anything,but finaliy police may advice both of you to approach comptenet court and get decree,which will be is the long process .

2) Is there any such enforcement force in BBMP for evicting such trespassers when BBMP/BDA have issued the Khata in my Name?
I think if your society takes initiative by depositing amount for evict illegal occupants,defiantly BDA will take initiative,but society would have to inure huge amounts.............

It is always open to you,but you shall file the appropriate suit for declaration and possession against the rival party as as denied your title.Therefore you have to pay court on the market value of the property .

Hi Murali,

Thanks for your legal support to forum members.

I purchased a flat in builder apartment (having 12 flats with 3 floors) near Whitefield, some 20 months back.

He had given possession in Mar-2010 and he sold all the flats now.

Builder is not co-operating in giving docs such as khata, occupancy certificate, etc. and not even switch ON the Lift.

He is collecting Rs.1000 p.m. towards maintenance from us but neither giving any receipt nor disclosing the accounts.

Now, we are thinking of forming association because builder has occupied entire terrace and constructed illegally on that and staying there and also planing to construct still more on terrace. He says entire terrace is his private space and not allowing us to terrace.

As per my knowledge, he don't have permission to construction and also he has not registered in sale deed.

How to get rid of the builder from apartment.

What legal action we can take? Kindly suggest.

Hi Murali,
Your times spent in helping the people in this forum is much appreciated.

I am planning to buy a DC converted, BBMP "A" Khata site near Bommanahalli.

Can you please advise me the pros and cons in buying this kind of site and also let me know the list of documents i should collect from the Land developer.
