One more Housing Society ordered to return 165 Acres

Fresh news of 29.2.2012:

The Supreme Court has directed Vyalikaval House Building Co-operative Society (VHBCS) to surrender 165 acres and 30 guntas to farmers, who have been fighting the state government against the acquisition of their land for more than 20 years.

A division bench comprising justices GS Singhvi and Sudhansu Jyoti Mukhopadhaya, on February 7, directed the society to surrender 165 acres and 30 guntas at Nagavara and other villages.

The top court dismissed the re-acquisition notification issued by the state government in favour of the society and set aside the high court’s order backing the society.

The court directed the society to return the land to the farmers.

However, it ruled that relief was not applicable to those who had withdrawn their special leave petition in the interim.

The state government had acquired more than 165 acres at Nagavara and other villages between 1984 and 1986 for the society.

Later, the farmers moved the high court questioning the acquisition.

“We are very happy with the Supreme Court judgment. We got justice after a long battle with the state government,” said Umesh Nanjappa, president of Nagavara and Govindapura farmers’ land protection committee

This information and paper statement is not 100% correct. Looks like they are confused with the two supreme court verdicts on BCCHS layout (Bangalore city cooperative house building society) and verdict on VHBCS Layout (vyalikaval House building cooperative society).

The first one (verdict on BCCHS) is clearly saying that BCCHS has to return the entire layout land to formers however in second verdict its saying only the land presently under the vyalikaval society has to return to formers and that land is very small. Vyalikaval society handover the most of the land to its members and developers and supreme court is not talking about any thing on these lands.

Supreme Court Judgement is published in first case however for the second case only the daily order is available.

My intention of writing this review is to give the exact information to the current plot owners in VHBCS (especially who bought the plots from Developes and in seconds they are nothing to do with that land acquisition). All the main guys escaped and the current owners are the victims. This is not fair..

@anilk - You are incorrect in first case too. In cae of BCCHS layout, the Supreme court has ordered to return only 11+ acres of land out of 220+ acres of land in which the layout was formed. Even the case was pertaining to only 11 acres from the owners of that portion of the land and the state govt. They never accepted the compensation amount right from the begining where as other land owners sold thier land for consideration. Please do not give wrong information that misleads the residents or members of BCCHS layout.

by chance would any body enlighten me as to what happened to the enqiry ordered by the state govt on all co operative house building socoeties recently in wake of the recent resignation by the then lokayuktha Justice Patil.

Has anyone got any update on the Vyalikaval HBCS Layout in Nagawara. What I understand is that there is a hearing by Supreme Court of India on 8th of July 2013.

If anyone has any Info on the latest update on Vyalikaval society, kindly share your thoughts!

The High Court of Karnataka on Tuesday quashed a government order (GO) and subsequent circular by the deputy commissioner of Bangalore Urban district, which directed the Vyalikaval House Building Cooperative Society to return the land acquired to the original landowners.
Justice Anand Byrareddy, while passing the order on a batch of petitions, observed that the GO was premature since the matter was pending before the Supreme Court. 
The court directed the State government to wait till the apex court delivered its judgement.

Hi Maniyar,

Could not understand the Court details

It means the Land is now returned back to VHBCS Society. So those who have bought can get relief because of this goof up.
It may be Society Mgmt issue & unnecessarily bothered the Site Owners. Finally High court and Supreme court given final verdict in favour of Site owners.

If you could clarify further on this, it might help to understand.
