Looks like there might be some litigation.
I have finalized a plot in first block (2100 range plot numbers). i approached a lawyer today and he said that there was a case going on and not sure if it is resolved or not. i have given the documents for legal opinion. however he suggests us to verify with locals who own plots in that block and check if there is any such litigation going on. Even though the seller is having the original BDA khata and registration certificate, my lawyer says that u can get it registered or sell to others while the case is still pending. i will wait till the legal verification is complete and try to contact some locals who have constructed house there.
If any one from this forum owns a plot in the number range 2100 and above or familiar with the area have any info on this, please share it. It would be very helpful.
Regards,
Prem

Re: Smv Block1 57 sites in problem
From the news that was spread, the power of de-notification is not with Chief Minister, It is with the cabinet.
Looks like there some thing really fishy happening.
I will try to get more information and update the forum.

It looks like one of the affected site is 1564/2 in Block 1 (Major Srikala C)......So I'm guessing the 57 sites would be around this site in SMV block 1

Re: Smv Block1 57 sites in problem
Hi all,
In my last visit to SMV BLK1, I noticed this company
has started work on 3 acre plot. which was marked as Park 4 and 5. The land owner has sold the land for this company i believe. ( THis was park land, Part of park 4 and 5). with a BIG storm water drain passing thru it. now he is developing this area to build row houses..see for yourself in net..
Here is the approx location marking only for Reference..I don't know the exact boundries..but in the area marked you can see all site numbers are covered with Black paint and roads are not being developed by BDA..only the Top half of the block is getting tarred..

Hope it helps..

Thanks all that a good lot info at this stage of confusions...it can be as guideline to alert all concerned..
Re: Smv Block1 57 sites in problem
Thanks for the details, Shankymysore. This appears to be a big scam by the BDA guys to rob the hapless allotees and pocket money. I looked up the area on Wikimapia, it appears that the area is actually closer to the KHB development.
All the art of living lies in a fine mingling of letting go and holding on....

Re: Smv Block1 57 sites in problem
Dear all,
I got a Audit report by CAG on BDA titled "Denotification of Land by Government and allotment of sites by BDA" it has all the details of Denotification done by BDA..and I found the history of SMV blk 1 denotification also.
The file size is more than 7 MB so I am not able to upload it. I will paste the relevant area for SMV blk 1. here the layout is mentioned as Gnanabharati layout. but survey no. and all is for SMV blk1. SInce both of them are next to each other.
=================================================================================================
The Government issued (March 1994) the final notification for
acquisition of lands required for the Gnanabharathi Layout. The lands so
notified included 12-13 acres of land in Sy.No.20 of Nagadevanahalli village,
Bangalore South Taluk. The award for the land in this survey number had
been passed in June 2001. Ten out of 12-13 acres in this survey number had
been granted by the Government under the Karnataka Land Grant Rules, 1969
to three persons before acquisition.
One person (P1) had purchased (January 2003) seven acres of land in
Sy.No.20 from the grantees in violation of the provisions of the KLRT Act
and executed (August 2004) General Power of Attorney (GPA) in favour of
another person (P2). Yet another person (P3) also irregularly purchased (June
2004) three acres of land in the same survey number from the grantees in
violation of the provisions of the KLRT Act.
P2 and P3 represented (17 March 2006) to the CM requesting for
denotification of the lands purchased by them on the ground that BDA had not
developed these lands and had not taken over possession. The Denotification
Committee, which examined (August 2006) the case of P3 recommended
against denotification as the land was required by BDA for the layout.
Though the case of P2 had not been referred to the Denotification Committee,
the PS recommended (August 2006) for the rejection of the request for
denotification on the same ground.
However, the CM ordered (May and September 2007) denotification of 10
acres in this survey number (three acres in favour of P3 and seven acres in
favour of P2, the GPA holder) citing that BDA had not taken possession of the
lands. Thereafter, the Government denotified (June 2007) seven acres of land,
in favour of P2 and three acres in favour of P3 (September 2007).
Though the denotification made by the Government was per se legally valid as
possession of land had not been taken, the reconveyance of the land to persons
who were not the khatedars and who had violated the provisions of the KLRT
Act by purchasing the land notified by BDA for a public purpose, was irregular

Re: Smv Block1 57 sites in problem
Another report on this :
Link : http://timesofindia.indiatimes.com/city ... 747511.cms
BANGALORE: There seems to be no end to Bangalore Development Authority's fraud and betrayal in the Sir MV Layout saga. The agency's denotification of land on which 57 sites had been carved out and sold to buyers is still unravelling as buyers are gradually coming to know about it.
Commander N Sharavana Gowda, 38, of the Indian Navy, is among the latest persons to learn that the site he bought from the BDA and where he planned to build his dream house has slipped out of his hands, thanks to the denotification fraud.
Gowda, who joined the Navy in 1993 and served in various parts of the country and also as ADC to the governor of Tamil Nadu for five years, was allotted the 50ft x 80ft Site No.1447/1 in I Block in 2003. He paid property tax promptly every year, but couldn't keep tabs on the site regularly as he was posted on duty away from home.
The BDA, meanwhile, denotified 10 acres in the layout in 2006-07 and gave ownership to two individuals. Though the land was described as 'muft kaval' (free forest land, something akin to grazing land and government owned), the denotification ended with vesting land ownership with the two individuals.
Unaware of these developments, Commander Gowda returned to Bangalore on a posting with BEL last year. He immediately drew up plans to build a house and even got a loan sanctioned from his provident fund account.
"I happened to read the Times of India online on March 23 and found a report about the denotification of 53 sites in Sir MV Layout I Block. I was shocked when I realized my plot could be in trouble and spoke to the owners of my neighbouring sites. They confirmed my worst fears," said Gowda.
Gowda first requested BDA to measure his site and fix its boundaries as he planned to construct a house. The BDA asked him to apply for a building plan approval. Stunned by BDA's stonewalling, Gowda asked officials about his site's legal status. "I asked BDA about the denotification and was told there was no litigation regarding my site. About the denotification, they told me I would be informed about it only after May 10 as the officer concerned was on election duty. This is ridiculous," he told TOI.
"I wouldn't have been surprised if some real estate dealer had done this to me. But a government agency like BDA cheating people is unjust. I want the same site. I plan to take leave from work and go on a fast unto death in front of the BDA office," said Gowda, who also plans to move court on the issue.
BDA officials were unavailable for comment.
Villas in denotified land?
A MV Layout site owner, who has filed a writ petition against BDA with regard to denotification, said a construction company plans to build villas or row houses on denotified land. He said advertisements about this are being issued in newspapers. "The hoarding at one of the sites and a newspaper advertisement have the same contact number," said another site allottee.
