Verification of the site/owner

Hello friends,

I am looking to buy a plot in south or west bangalore. I had some queries, in general, related to buying a site.

1. How can i find out if there is any litigation on the property? Is it only by getting a legal verification, or can I personally do some activity to find it out upfront?
2. How can i be sure that the plot that is shown to me and the actual site being registered are the same? The reason for this question is that I may be shown one plot, and provided documentation for the same for my verification. But finally the sale may be of some other plot. Is it only during registration that we need to look at the sale deed and verify the details of the plot or is there some other way to handle this?
3. Do we have any legal issues related to BDA layouts - specifically when BDA sites are being re-sold, has there been cases of mutliple sales of the same site or such legal issues? I know this happens for non-BDA sites, but this is specifically related to BDA sites.
4. Is there any checklist prepared based on your experience, on what items to consider while buying a plot?

Answers for your questions:

1. You can find out litigation on the property by checking for any court cases on that particular survey number by searching for the names available in the deeds in the High court website( website link can be searched in our forum itself). And also you can enquire the neighbours to know it upfront.

2. Thatsy you need to have a Layout plan. Layout plan is the proof that the guy is showing the right property. And also if you can get the survey number, village and hobli, you can apply for EC and make sure that it shows the correct owner by cross checking the sale deed. Why will someone look at the sale deed during registration? you have to verify it by lawyer soon after you get papers and before paying any amount to the seller. You seem to be new to this field. you plz contact lawyer before u take ur own decisions and ask questions to him.

3. you can buy a site which is re-sold 100 times. that doesnt mean that site is under litigation. What kind of legal issues u mean? plz contact lawyer
