I am negotiating with a developer in North Bangalore (Abbigere) for a 'BDA approved' layout. He has given me a BDA Khatha for the land, in his name with his photo, though he is only the POA holder.
Is this possible? He says BDA will issue such a Khatha if the original owner issues a letter in the name of the POA holder, authorising him to get the Khatha in his name.
Can anyone clarify if this is genuine?
Thanks,
Kaustav
Can POA holder get BDA Khatha in his name?
Re: Can POA holder get BDA Khatha in his name?
hello kaustav
there are lot of if's and buts with respect to the POA. Better consult a lawyer or a legal consultant for better clarification.
This you must keep in mind.
POA, is only for taking care of the activities related to the asset on behalf of the original owner based on his permission, but they're not the title owners. By Rule, in case of any conflict or dispute about the land or transaction, you need to file a case only against the original owner of the asset, not the POA holder.
At the same time, the original owner can cancel or terminate the POA at any point of time without giving any reason to the POA holder.
