how to complain to BBMP on neighbour violating rules

Hi All,

Can anyone suggest me how/where to complain to BBMP on construction violations done by my neighbour.

Also can anyone point me to a location where i can get all the bye laws of BBMP

In first place, your building must be in compliance before complaining on your neighbours.

You can lodge a formal complaint to your zone BBMP Executive engineer(Civil Incharge) and get the acknowledgement from them without fail. Just by giving a written complaint once will not solve your issue. Since 99% of the constructions happening in bangalore is violating bylaws and in all these activities BBMP people get handful of money as bribe whenever they do site visit. Infact they only encourage prople to violate the bylaws in many cases by giving various tips. Hence they don't act on these kind of complaints easily. You must have to invest plenty of your precious time to follow-up and also to get the progress status/action taken on your complaint in writing through RTI procedure. If BBMP Doesn't act, you may have to approach media with documentary proof and also file a case in Civil court.

Is your neighbor still constructing the house or has he completed the construction? If he has completed the construction, it will be tough to get it demolished.

Why don't you talk to your neighbor about it first. I had a neighbor who was constructing the entire width of the site till the boundary leaving no setbacks. The site was adjacent to our vacant site. I spoke to him and raised objections. He mentioned that his site had lost 3 feet due to this, he was not able to leave the setbacks. I stood firm and told him that was not acceptable. He then did some modifications and arrived at a reasonable compromise. The neighbor was a builder and PWD contractor for BBMP. Yet he was willing to compromise.

So my advice is to talk to your neighbor and come to an amicable settlement. Go to BBMP only if the talks fail.

Thanks for all your replies... just to give you all additional information.

My neighbour house is fully constructed and has the following deviations.

1. 2 of the pillars are attached to my boundary but if'm building a wall of 2ft height and of 2ft width above my compound which comes between his pillars and he has a problem. How can he justify this ? when he himself has 2 pilars where i've built 2ft wall.
2. Balcony at 1st floor has been extended to my site boundary.
3. His complete staircase at 1st floor is attached to my site boundary. As per my plan a bedroom is coming in this place and I’ve been suffering with lack of lung space.
4. He has put a stone to wash clothes in the utility which will make water fall on my wall. Request him to cover up the same.


Also i need your guidance in terms of letting me know if i have any deviations.

1. My staircase landing is close to his wall. (I'm assuming that normally staircase are constructed in the end attaching to the next guys wall.
2. I have left 2.6 ft on the side and 2 ft in the back and 15ft in the front.
3. even my first /second floor is not touching his boundary.

BUT MY QUESTION IS THAT IF WE DONT ALLOW 3FT ALL AROUND , IS IT A BIG DEVIATION. (Actually i have never seen a house in bangalore built on 30*40 with 3ft set back all sides)

Please guide me.

Hi Nagraj,
Its simple, you can do nothing much about him,since its a constructed house.I faced these issues in couple of projects.I feel pity with these kind of neighbors,You need to be little over smart him.Wait for the time he goes out for holiday (being a holiday season).Finish your job as quickly as possible before he returns. Threaten him that you will demolish his pillar footings that are in to your site (just a try ,don't take the discussion too far).Keep cool and get the job done with out involving any BBMP guys.Try to hold objection works till the end of the project and one fine day surpriseeeeeeeeeeeeeee :)

This is the main reason why the bye-laws exist. If everyone followed it, we would have no problems. But each one thinks a small deviation is ok and moves along not realizing that that small violation is going to be a problem for his immediate neighbours who then have to create their own violations and the snowball starts to get larger!

i just wanted to add on few more conversation... Even though my neighbour has done so many violations he is threatning me saying that he will get stay order from the court for constructing the wall ... Is it really possible or is he just threatning me. I find so many house where they have one side or 3/4th of the wall built attaching to the neighbour... Is it such a big deal.

Hi Nagaraj,
I would suggest to follow what Ar.Praveen.N suggested. There are several reasons for that. First and foremost if he goes to court he can get a stay order. This means a lot for you. Half constructed building, investments that you made will be locked etc. Once he gets stay his lawyer will drag the matter as many years as he feels. You can't do anything.
Second, since you are going to live there it is always better to get a good relationship with the neighbor.
Third, you can't buy ventilation and light. You can e.g. build a floor but never ever get more light and ventilation. You will never be able to alter the building later if you want a small piece of personal space to accommodate for plants etc. May be you work out plan so that you don't violate.
