hi,

First risks associated with B Khatha are

> You would need to pay a penalty in the future when the government comes up with the regularisation scheme.The last time when they announced the regularisation scheme it was approx Rs 48,000/= for a 1200 Sq ft site( but the governor objected to it and the scheme was stopped)

> Regularisation scheme has been in news from 4 years but it has still not come in force,Personally I don't think it may happen even in the next 2 years.

> Now, if you buy a property with B Khatha, you would find it very difficult to get a bank loan for the purchase of the site. Do check with Sundaram and DHFL, I heard that they do it.

> You will not get a building plan approval, so if you plan to construct a Home you need to do it without building plan approval and so NO LOAN FOR CONSTRUCTION.

based on the above take a call.

B Khatha also has to be verified in the BBMP office only.
Encumberance certificate only shows the flow of property and it has nothing to do with the Khatha.
If there are a few sites in the same layout with A Khatha, then I would suggest you to find out in the BBMP office as to why is it so that few sites have A khatha and this has a B khatha. There could be a possibility that the present site owner does not know that his site can get a A khatha.( this thing has happened in a few cases wherein in 2001-02 there was a regularisation scheme and in that the previous owner would have paid and they woul d have lost the receipt and the present owner is not aware about it and has applied for a B khatha). To check if this is the case you need to bribe the BBMP officials and make them check the old records and see what had actually happened.

If possible get a copy of the A khatha of any site owner of the same layout and go to the BBMP office and show them that if he could get a A khatha and why not for this site.

If it is possible to get a A khatha for your proposed property do get that first(you may need to pay bribe and get the A khatha but please ensure that there is a book entry.
The best way to check if there is a book entry to to apply for a khatha Extract after getting the A Khatha.

Why I suggest you this is many agents get you A khathas in original copy but it may be fake. There have been many such instances.

Yes I heard there are possibilites of fake 'A' katha..

How can check if the certificiate is genuine ... ?

Please don't go for such sites ('A' Katha in Non-approved layout) unless the layout plan is clearly laid out and also approved by a competent authority, otherwise there is always chance of what Mr. Chandramouli has stated here.

What puzzles me is, how it possible to get BBMP A Khatha even without DC conversion as sited by Leela PK?
