Is SMV BDA layout safe?

Hi All,

Is purchasing a plot in SMV BDA layout safe? couple of years back i heard there was some litigation where 140 buyers were sufferred..pls share if you have any info on this.

No layout is 100% safe. Only BDA advantage is they give alternative sites if the BDA site comes under dispute. Getting alternative site is not easy if you are an individual fighting with BDA. If many people are affected e.g. when court disapproved some sites formed in forest, BDA quicky gave alternate sites to avoid media attention.
The rule of alternative site is: They will give a site formed together or after the layout where the site is under dispute.
I know SMV case where my friend was affected. It was not simple case but involving lot of organized land grabbers. Huge number (may be 100+) of sites were affected. Site owners did win the case but had to spend a lot money and time.

My advocate friend suggested that constructing the house is more safer. That way court generally takes lenient approach for house owners.

thank u for ur response, does this rule apply only to persons who were allocated directly from BDA or even for persons who have purchased from direct allotees? purchase?

BDA has played with the rule of eligibility few times, Initially BDA rule made even purchaser also eligible for alternate sites. But at some point of time (not too sure how true it is) changed the rule to apply only to direct allottee. Then again in 2008/2009 BDA changed back the rule to consider even the purchasers. As of now, even purchasers are eligible for alternate sites if there are disputes.

I have been a victim of site puchased in SMV Layout way long back in 1996, I am the first purchaser of the site,

There are total of more than 150 Plus people who are facing problems, this is only in one of the phases near to the venkteshwara temple.

Dirty Politics has created hell lot of problems and though we had appointed lawyerrs to fight,
i think they were all lured with money by the landlords/hooligans and are taking their sides.

I was just pointing about the soft corner court showed about the people who have constructed houses. For plot owners court has not given any mercy.

Agreed, it is silly, either the site belongs to the original owners (who owned the agricultural land) or the new owners who constructed the house. How can only the vacant sites belong to the original owners of the site and the ones that have houses go to the new owners? So is it ok to construct a house on a land that did not belong to one? The supreme court seems to think so.

SMV layout was formed by BDA and allotted during 2002-2003. So are you talking about issues with BDA allotted SMV Layout or one of the private layouts near SMV Layout?
