Lagality of Apartments on BDA allotted site

Hi,
Today I visited a property in Kumaraswamy Stage-1 Layout. I am told it's "BDA" 60x40 site and the owner is direct allottee from BDA. Now he is constructing G+3 building with 8-apartments (& one pent house which owner admitted is not authorized). Each apartment is around 1100 sqft with no common walls and asking price including registration(with bribe! around 25-30000) is 33lacs negotiable. Axis Bank, IDBI, LIC is giving loan for this property as per owner.
Could someone please tell me if this kind of construction on BDA allotted site is legal (owner is claiming he got BDA approval for this 1-1.5 years back but started construction lately) and how to verify the claims of owner? What about BBMP approval? I heard that nowadays site less than 8100 sqft are not allowed to do so.
Also there is some obvious deviation such as there is no required 4-5 foot space is left on either side of building. How akrama-sakrama scheme going to affect this purchase?
