Minimum Area for building apartment

Hi All,

Do we have experts here, who could guide and answer my question: What is the minimum area of plot needed for constructing an apartment?

The reason I'm asking this question is: I've been meeting lot of builders/agents for buying an apartment. I recently saw a property - The plot area is 2400 sqft (60X40) and the builder is constructing 10 units (2 units X 5 floors). He is offering 1350 sqft, 3BHK @ 33.5L (Parking, BWSSB, KPTCL, registration - All Inclusive). While this rate is very attractive, I'm concerned if this kind of property will be approved for construction by authorities. I've come across people who have told that, for constructing an apartment, minimum area should be atleast 5000 sqft.

Appreciate inputs from experts here.

10 units in a 2400 sqft plot is downright illegal!! Minimum site dimensions for constructing apartments is 7150 sqft as posted by Praveen in this discussion http://mybdasites.com/viewtopic.php?f=37&t=1797

According to the bye law 2003,In the case of ‘high-rise buildings’ the minimum set-back all-round the building shall be 8mt. Minimum depth or width of a site for high rise buildings shall be 21 mtrs.
Minimum road width facing a high rise building shall be 12mts.

So site area should be 4750 sqft minimun.

and in 40x60 plot you can construct 3 diff houses in each floor and you can sell it. but not more than 3 floors including ground.

Hi,
Minimum plot to built apartment is 8100 sft as per BBmp.Any thing constructed in lesser plots are violations.They are approved as individual buildings and bank funds via back door.I am not sure what will be legality issue in future .

yes Praveen is right, according to the latest zoning regulation2007-2015.
c) Multi dwelling units (Apartments) shall be allowed only on plot sizes of above 360 sq.m in
the I and II Ring and on plots above 750 sq.m in the III Ring. In both cases, the road width
shall be more than 9.0m.
Looks like ring 1 & 2 comes under BDA and Ring 3 comes under BBMP.

@ Praveen can you explain me this? BDA & BBMP , which all area comes under this . as i understood older bangalore is under BDA and new area under BBMP but upto where any idea?

Just to add clarity:

This building has ground level parking. Then, the builder says he has approval for 4 floors and 1 floor is unapproved. In each floor, he is constructing 2 house, a 3BHK@ 1350 sq and 2 BHK@ 1000 sq.

Btw, I approached two nationalised banks for loan, and they both have rejected to lend loan for this property.

BDA is the planning authority and the BBMP is the Municipal Authority entrusted with providing basic infrastructure and maintenance.

Thanks ecopackindia, by mistake i wrote BBMP instead of BMRDA. Any idea of rings/zones? which all area comes under ring-1,2&3.

Aparna,

On a 60x40 or 30x50 i know one can build 3-floors (G+2), with 3 individual homes. But my builder told you cannot sell the individual homes
as they would have a share in the floor, which makes it similar to apartments. He said you can sell as a whole (G+2), with total 3-houses, thats all.
Which is correct ? Any references.

Hi,
This is not a detailed info, but in a nut shell summary.
If your plot is within II ring as per the BDA CDP 2015, then you can construct an apartment (5 units and more) on a site measuring 4000.00 sft or more, Else if you are in the III ring as per theBDA CDP 2015, then you can construct an apartment only on a site more than 8085.00 sq.feet. You may construct a 4 unit house in any site dimension, provided you can accomodate 1car park for each unit in the ground floor. You will get an approval for 4 unit not as an apartment but as a multidwelling unit. you may also sell the units separately to any pottential purchaser.
