Documents to be obtained from builder.

I have gone through the following post : http://mybdasites.com/viewtopic.php?f=33&t=29
and was unable to find the details of the exact documents required.

Can anyone please list the required documents for the following questions.

For buying a flat under BBMP.

1.What all documents are to be obtained from a builder for examination with a lawyer?

2.Do we need to engage an engineer to find out the deviation and the amount of deviation from approval or the lawyer itself will take care of these examinations?

3.Can anyone suggest a good lawyer whom I can approach for verification of documents in Marathahalli/Brookefield area?

Here are some mandatory documents you should get from your builder -

1) Previous Sale Deed (Mother Deed) or Partition deed
2) Khata Certificate
3) Khata Extract
4) Tax paid receipts till date
5) Encumberence Certificate ( Minimum 13 years)....Some ask for 40-50 years as well
6) Joint Development Agreement + General Power of Attorney
7) Approved building Plan or Drawing Plan
8) Receipts for Betterment charges paid by the builder

Also check if its approved by BBMP, CMC or Gram Panchayat. DO NOT BUY if its from gram panchayat only.

Hi,
1) Previous Sale Deeds ( earlier 3 transaction deeds/Mother Deed)
2) Khata Certificate
3) Khata Extract
4) Tax paid receipts till date
5) Encumberence Certificate ( Minimum 13 years)....Some ask for 40-50 years as well
6) Joint Development Agreement + General Power of Attorney
7) Approved building Plan or Drawing Plan
8) Receipts for Betterment charges paid by the builder
9) If originally it was agricultural property RTC extracts
10) Conversation order
11) endorsement regarding violation of Section 79 of Karnataka Land revenue Act.
12) endorsement regarding Land reforms Act
and others documents which needs more clarity.
