What are the documents are require for clear title BBMP-khata sites?

1- Sale deed , which should reflect the current owner name and previous owner name.
2- Sale agreement
3- EC up to date
4- khata certificate
5- Khata extract
5- Up to date tax paid receipt`
6- DC conversion order

BBMP khata means nothing more than a "account certificate" for payment of municipal charges. BBMP is not a approval authority for layouts. BDA and BMRDA are.

Here is a list of documents to be verified for non-BDA layouts and apartments:

1. Registration documents - get certified copies from Sub-registrar office

a. Mother deed
b. Sale deed
c. Encumberance certificate for last 30 years matching the sale deed history with no mortgages
d. Last 30 years RTC (Pahani) document clearly showing ownership (http://www.bhoomi.karnataka.nic.in)
e. Search for any court cases in the name of party - http://causelist.kar.nic.in/caseStatus_PartyNameDistrict.asp mandatorily get a endorsement at Asst Commissioner office for no DC court cases on the survey numbers.


2. Approvals for layout formation

a. Bangalore Urban Deputy Commissioners approval for conversion of land use from agricultural to residential/commercial (MUST)
b. If the area falls under BDA jurisdiction then BDA layout approval document is required Else layout should be approved by BMRDA or one of its sister organizations. (MUST)

The layout approvals authorities are Corporation/BCC (areas in interior Bangalore), BDA (areas inside city limits, except corporation areas), BMRDA (areas upto 40-50 km around the city, except BDA areas), BIAPPA (areas near airport), Lake Development Authority or LDA (areas close to designated lakes), and respective village Panchayats (for areas far away from the city - basically those areas where BMRDA jurisdiction has not yet become applicable)


c. Layout should not appear in BDA unauthorized layouts list - http://www.bdabangalore.org/pdfs/bdaunauthorisedenglish.pdf
d. BDA/BMRDA & KIADB NOC that they are not in the process of acquisition of the said land



3. Municipal taxes and dues verification - manual verification at respective BBMP ward revenue office

a. Non-conditional A Khata certificate in the name of the current owner as mentioned in sale deed
b. Khata extract clearly mentioning the title to the owner, dimension of the land, builtup area and the adjoining lands. This should match with schedule in latest sale deed.
c. Upto date betterment charges paid receipt
d. Tax paid receipts upto date
e. No objection letter for Khata bifurcation and transfer from BBMP ward revenue office


4. Compliance to municipal building byelaws for dimension, usage, height - BDA engineering / BBMP ward engineering office

a. Apartment plan sanction from BDA/BBMP engineering office

d. Occupancy certificate from BDA office
e. Airports Authority of India NOC


5. Water and sewage verification - BWSSB, KSPCB

c. Verify if BWSSB has cauvery water pipeline in the area or plans to do it - BWSSB office, Jalbhavan, Bannerghatta road

I am considering one site in Horamavu which is DC converted, B khata site. They have all the other papers like EC, BDA noc etc
Should I buy this site or not? Please let me know

Hi Shivali,

It is not that if all the papers are there, you can buy the site. First, you have to show it and scrutinize the papers with lawyer, then you can decide. You dont get loan from any bank if it is a B Khata site.

Nagarjunkatta,

We will get it checked by the lawyer. My only question is should we even consider buying a B khata site. Some 'not so popular' banks are giving loans for B khata.
I just want to know from 'legality' perspective is it ok to consider B khata?

the thing is u shud see whether the B khata can be made to A Khata in future when the BBMP takes betterment charges. This can happen only when the layout is DC Converted. So simply dont decide.. lawyer wud give u a fair idea reg this.
