Buying a BDA site which has a sale restriction for 10 years

Hi,

I have finilised a 20*30 BDA site in J P Nagar 8th phase. This plot was alloted in 1999 and had 10 years sale restriction , but the original allotey has sold this site in 2005 to some person 'xyz' , now I am planning to buy this plot from Mr xyz.

Is it safe to buy this kind plot as the original allotey has voilated the BDA law and sold it within 10 years sale restriction period?.
Can BDA take back this kind plots where original alloties sell the plots before 10 years sale CAP.

How do you know BDA had a 10 year restriction in JP Nagar 8th phase ? Subsequent BDA sites like BSK or Anjanapura don't have these. BDA was going to implement only for future allotments, like the Kempegowda layout.

Exactly...my site in JP nagar 8th phase does not have the 10 year lock.

Hi,

The 10 years lockin period(sale restriction ) is clearly mentioned in the Site allotment letter(possesion certificate).
For the sites which were given to land owners there is no lockin period.
One of my friend has a house next the site which I have finilised and there is no lockin period for his site/house becouse its a land owners share site.
