Plan layout verification

Hi all,
I am planning to buy a penthouse in Arakere layout. However, when verifying the plan layout, I found that the room they had built on the terrace was not present in the plan layout they had got approval for. Apart from that, there is also other deviations present in the lower floor itself. He had showed a utility being present, but there is no utility provided. He has just extended the kitchen.
however, apart from this, everything else is perfect - kaatha / OC / taxes etc. SBI and HDFC are ready to give loans. The builder is also ready to give an agreement saying that he will bear the cost of regularising the apartment if there are any problems.
But, I am not sure if we can go ahead with the purchase of this apartment.
There is a minimum deviation that is permitted right? Can anyone give me the correct percentage of deviation permitted? Also, I would like to know how I can calculate the percentage deviation? Who would be able to help me with that calculation?
Can I go ahead with the purchase of this apartment? Would there be any problems later?

The violations are commonly done by most of the builders; penthouse will be always a major violation. Even the banks don’t give loans for these.
If the builder is not giving any great discount (particularly on pent house) then I would say to be on safer side. Many builders promise to take care of paying the fine in case of violations, but then once he sell all the flats he don’t even care about it.
Any building 5% deviation is permitted by paying fee.....while occupancy certificate is given.
By the way is it bbmp or bda approved ?

Each floor of the penthouse in some apartment projects in bangalore(even from reputed builders) have been registered separtely, which means that every year the owner is having to fill 2 separate forms for property taxes foreach floor. This was done for reasons best known to the builder. You could check on this aspect too.

Thanks for the reply. The flat is BDA approved. And SBI and HDFC are ready to give loans. That is why we thought of going for this flat. And also, we got a good deal for this.
The deviations, on the whole, comes to around 12%. Our lawyer told us, we could get this regularized in the coming "aakrama sakramaa". Let me know your thoughts again.

Hi friends,
I am new to this site and really appreciate the genuine concern of all members to share the information thru this forum.
Dear friends, I am planning to purchase a BDA house built on 20x30 plot. Ground + first floor plan is sanctioned and tax is paid for 800sq ft builtup area.
But actually he has built ground two floors and built up area is around 1800 sq ft if staircase parking and ventilation/utility is included. It is a BDA allotted plot. All the documents are clear, except for this plan. Almost all the houses are built like this in this area. IDBI Bank is ready to pay loan on this. My question is
1. what is the allowed FAR?
2. Can i get the second floor plan sanctioned later on?
3. Can i pay the deviations fine thru akrama sakrama?
4. Will the authorities slap fine on the building?
5. what will be consequences later on?
I am planning to buy this out since this is near to my Parents house and convenient for me.
Friends please help me out.

FAR permitted is "1"
2. Can i get the second floor plan sanctioned later on?
Getting second floor sanction is not a very difficult thing, provided to spend some more money or you can built it and regularize in akrama sakrama
3. Can i pay the deviations fine thru akrama sakrama?
yes you can do for all the violated sft
4. Will the authorities slap fine on the building?
They wouldn't really bothered about small residences (no guarantees ),they all ways target apartments, semi commercials etc...
5. What will be consequences later on?
Till date there is not even single case of demolishing a residence due to violations, at most you may have to pay them one time to keep them calm. It is a very common practice to violate and pay penalty.

Hi Ardes,
What if my flat (in the first floor) has a deviation within 5% but there is pent house on the fourth floor which is against the sanctioned plan. Will I also be affected due to the pent house's deviation. Could you please elaborate how could I be affected here ?
