gated comunity ??

I have recently read news related to some dispute between BMP and an big apartment complex in JP nagar( I think not sure). The dispute seems to be that BMP is asking the apartment builder to remove the compound wall of the apartment complex so that the some 4 acre park with in the apartment complex can be accessed by the public. The flat owners says they have no idea about this builder always shown this park as part of the aparment complext itself.

So then I got this doubt, as per the rules, the so called gated communities shall open their parks , open spaces for public usage?? It seems like. Can any one throw some light on this subject?? If some one is planning to buy plot or flat what are things they should look into??
