Advocate Murali..Please help

I am looking to purchase plot around Bangalore (not sure the location as I am still looking and have not identified one in particular). I may end up purchasing the site from a developer or individual or agent. Please help me and other members by letting us know what documents should we ask for to check the authenticity of the owner and how do we get them verified. A comprehensive list that covers all the documents will help us buyers to ensure we don't get cheated. Also, please let us know what are charges that are legally binding and what are charges that are negotiable? One of the developer I spoke to mentioned that I need to pay close to 1 lakh rupees annually for maintenance, KEB, legal, sanitation etc. Are these charges negotiable or is it mandatory charges? Also what is the normal registration costs (stamp paper etc) for a site? What percentage should one expect to pay? Your guidance in this regard would be very helpful to us members.Thanks.

Hi
As far as residential flat in concern, first you have to verify the following documents in order to clarify the title of the owner and for compliance of legal requirements .
1. Title deeds like original property documents and its mother deeds Etc. ( if it is agricultural property you should verify the RTC extracts . Apart from that if it is Joint family property you suppose to verify whether other members more particularlly female members have got their share or not.
2. Conversation order : IT is compulsory for agricultural properties , the Deputy Commissioner of Revenue is the competent Authority .
3. Sanction plan : As for as Bangalore City is concern the BBMP is competent authority to sanction and approve plan . In other cases the concern municipal council . You must verify whether the apartment has been constructed as for the sanction plan or not.
4. Encumbrance certificate and tax paid receipts .
( For better clarification, it is advised to take assistance of any legal expert.)
Secondly , for the registration of any property whether it is flat or site , The purchaser shall pay 8 to 9 % of the market value property as stamp duty to the Govt by way of DD . Apart from that there would be nominal registration charges which amounts with in 3 to 4 thousands. .
As far as flat is concern you need not pay any fee to any body except regular charges like BEscom fee for using Power and Water charges etc.
Maintenance charge are concern it is understanding between the co owners , normally that charges will be there in apartments because the flat owners uses the flat jointly.

Thank you sir for your guidance. Can you specifically provide the list of documents that I can request a land developer/individual for verification before purchasing a plot.
