BBMP Khatha extract query

Hello all, hope you are doing fine. I need some expert advice on BBMP Khatha extract for a house.

I am planning to buy an independent house which has A Khatha. When we got the latest Khatha extract, it just shows the land area and the building area is not captured on it. Lawyer asked for it to be included before registration as it will help in determining the building valuation.

But the seller is reluctant and said he visited BBMP and their engineer said it wont be done until the property changes hands again.

So my query is who is correct here and anyone has come across this situation or have a point of view? Many thanks.

I agree with your lawyer. Before any sale, the status of the property should be current and latest, meaning khata should have all current details and taxes paid up-to-date. This shall also reflect in the future sale deed document, hence, important. The reluctance of the buyer might be because a building requires more property tax to be paid as against a vacant land. I'm also surprised that if this person has not paid building taxes (tax calculation is khata based), how did the person manage to get BBMP approval for the building plan, followed by OC? When BBMP issues OC to a building, it should be followed by khata updation and in turn, tax calculation updation.
Lastly, khata records updation comes under the purview of BBMP revenue officer and inspector, not Engineer

To provide mode details and my personal opinion.
1. When mentioned as A Khata, it means the site is a revenue site. Hence, I recommend you dig deeper into this if it had the Municipal Khata before getting under BBMP. If this is available then there is no problem in proceeding.
2. As mentioned rightly, it's the Revenue Inspector who has to update the measurement of the building and not the Engineer. You can ask the seller to get the Extract updated which is very easy. If you run into trouble, approach the Assistant Revenue Officer and you can get the work done.
3. Further, on a personal note, please check for any pending property taxes. The details declared in the property tax scheme are as-is on the ground including any rental portion. This is best done if you can get the Revenue Inspector into confidence and then ask them for complete information.
