BDA approved layout, Site has no BDA Khatha But BBMP A Katha

Hi Friends,

There is a unique situation that i am facing, a plot that i have seen has BBMP Khatha, but no BDA khatha though the site is in a BDA approved layout.

The land owner said that he got the BBMP Khatha done directly as the property is now in BBMP jurisdiction and has been transferred to BBMP now.

He never got a BDA khatha done, should he get a BDA khatha done or is it safe to proceed with the BBMP Khatha.

The plots next to this plot have BDA khatha, please share your thoughts.

I want to know if there will be legal implications if we proceed for the sale deed on the BBMP khatha without getting a BDA khatha.

Backdrop: Saledeed Executed by the society in 1995 to the allotee, Area transferred to BBMP jurisdiction in 2004, in 2005 the owner has got a BBMP Khatha, all the taxes are paid upto date for BBMP.

Society has given a NOC.

Allotee must have had a BDA Khata in 1995. If owner is not the original allotee and is a second buyer, he may have a BBMP Khata (A as well as B).

If things are not as they seem, do due diligence and verify history of the title of the property, right from the beginning.
Better to be safe now, than sorry later...

After allotment and registration, if the owner has not applied for Khata and subsequently the Land is handed over by BDA to BBMP means,
at a later state, the owner will get only BBMP Khata. There is no harm in this.

What you need to verify through the Bank is, will it affect in anyway for getting bank loan( if you are going for Site loan).

What MSN1270 said is correct. During 2005 BDA had stopped issuing Khata for some of the BDA approved layouts. And when they reopened issuing khata the layout was already handed over to BBMP and BDA refused to give Khata. I had seen a site in Bank Officers Layout with this issue and my friend brought it without any problem to get even the loan through ICICI bank.
